Oh, and as for "slipping", that sounds more like a clutch issue in the transmission. There's really nothing to slip in the axle.

You said he told you that, on the road it "jerks". A "jerking" and a "slipping" seem to be different to me. Slipping wouldn't be as big a deal as something jerking.
I'd definitely investigate further before buying.

Can't remember on the 76 but if it has a AMC 20 rear axle it might have spun a hub on the axle shaft (tapered axle) was a common problem with that axle.

If it truly is something in the rear end causing it to jerk (I'm thinking gear teeth broken), then just pulling the shaft will not help. Those (possibly) broken teeth will keep catching at times and could prove disastrous.
I don't think it sounds drivable in any case right now.
I had something similar happen to my Wrangler. One of the Dana 30 (front) side gears broke two teeth. I wound up having to trailer it, or I may have really trashed the whole front.

Ask if you can pull the rear diff cover to inspect the gears. If not, then the following is how you can tell without pulling the cover. You'll need a floor jack.
First
Find out if it is an open rear or has some sort of "posi" in it. If it's open, jack the rear axle off the ground (both tires) and turn one. This will roll the spider gears around. Make several rotations in both directions. As long as the other tire turns in the opposite direction and you don't hear any strange noises and nothing "catches", and then turns both tires the same direction, then it may be fine.
If the axle has a "posi" (or, limited slip) system of some sort, you probably won't be able to do this as the posi unit will not let them turn independent. Although, you can try raising just ONE tire off the ground and turning it. This will serve the same purpose. (That's if the posi let's the un-grounded tire turn.)
For the ring and pinion gear check, posi or open,--With both the tires off the ground, and the trans in neutral (chock the front), turn the driveshaft several times in both directions and listen for noises or that "catching" again.
If it's smooth and noise free, then the problem is, most likely, elsewhere.

Hope this helps! Keep us informed.

Hey guy, I was looking at a 1976 cj5 with a 304 and 3 speed,He said the rear end was slipping on it or the something in the driveline he said when you get on the road it starters to jerk like something is slipping. So what do to fix this? I can I drive the jeep in four wheel drive and take the back drive shaft out? thanks ritchey
